18 Miss. Code. R. 23-9.2 - External Appeals

All Division of Administrative Hearings' decisions, except for Subgrant Administrative Hearing decisions as described in Rule 7.11 Review of a Subgrant Administrative Hearing Decision, shall be final and binding. Any decision rendered by the Division of Administrative Hearings' decisions may be appealed to a court of competent jurisdiction.

In the event the appellant requests a transcript of the hearing record for the purpose of an appeal, the following conditions shall apply:

A. The appellant must submit a formal request for the transcript.
B. The appellant is responsible for covering all associated costs for the production of the transcript.
C. Payment for the transcript must be received in full before the record will be produced or delivered.

The Division of Administrative Hearings is not obligated to prepare or release any transcript until the appellant has fulfilled the payment requirement in advance.
