23 Miss. Code. R. 300-2.20 - Group Hearings
A. A group hearing
can be held for multiple applicants or beneficiaries under the following
circumstances:
1. The Division of Medicaid
may consolidate the cases and conduct a single group hearing when the only
issue involved is a single law or agency rule common to all members of the
group.
2. The applicants or
beneficiaries may request a group hearing when the only issue involved is a
single law or agency rule common to all members of the group.
B. In all group hearings, whether
initiated by the Division of Medicaid or by the applicants or beneficiaries,
the policies governing fair hearings must be followed.
1. Each individual applicant or beneficiary
in a group hearing must be permitted to present his/her own case and be
represented by his own lawyer or withdraw from the group hearing and have
his/her appeal heard individually.
2. As in individual hearings, the hearing
will be conducted on the issue being appealed, and each applicant or
beneficiary is expected to keep his/her testimony within a reasonable time as a
matter of consideration to the other clients involved.
