23 Miss. Code. R. 300-2.8 - Time Limit For Filing A Hearing Request
A. The applicant or
beneficiary has thirty (30) days from the postmark date of the appropriate
notice to request either a local or state hearing. This thirty (30) day filing
period may be extended if the applicant or beneficiary can show good cause, as
determined by the Division of Medicaid, for not filing within thirty (30)
days.
B. When good cause is shown,
a late hearing request may be accepted, provided the facts in the case remain
the same.
C. If good cause for
filing a request beyond thirty (30) days does not exist, a hearing request will
not be accepted.
D. If the
applicant or beneficiary wishes to have his/her eligibility reconsidered after
this period, s/he may reapply.
