30 Miss. Code. R. 2901-7.1 - Delegation prohibited
(a) No optometrist
shall delegate authority to a lay person to perform any act requiring the
exercise of professional knowledge and judgment on any patient whose visual
welfare is the responsibility of the licensed optometrist.
(b) Non- licensed supportive personnel may
not delegate diagnosis or treatment duties under any circumstances.
(c) To ensure patient confidentiality of
examination records, a non-employee shall not be allowed to perform any task or
function which would require or give them access to patient records or
examination reports of any person without prior written authorization of that
patient. (This provision shall not be applicable to restrict access to patient
records of staff members who are paid through employee leasing
plans.)
(d) The licensed
practitioner shall be responsible for all delegated acts performed by persons
under his/her direct and general supervision.
