6 Miss. Code. R. 401-1.9 - PURCHASING PRACTICES
(a)
General Policy Statements. In accordance with Section
31-7-9 the
District shall not purchase any commodities covered by existing purchasing
regulations unless such commodities be in conformity with the standards and
specifications set forth in the purchasing regulations and unless the price
thereof does not exceed the maximum fair price established by such purchasing
regulations.
(b) The Executive Vice
President or his delegate is hereby charged with the responsibility for
insuring that purchases are made from the lowest and best bidder, when bids are
required by law. If any bid other than the lowest bid actually submitted is
accepted, the Executive Vice President shall place on the minutes of the first
Board meeting after such acceptance, justifiable reasons that the accepted bid
was determined to be the lowest and best bid.
(c) The Executive Vice President shall
determine whether an emergency exists in regard to the purchase of any
commodities or repair contracts within the meaning of Section
31-7-13.
In the event such an emergency is declared, the Executive Vice President shall
document the circumstances surrounding said emergency in accordance with
Section
31-7-13(j).
(d) Unless otherwise stated in these
regulations or provided by statute, the Executive Vice President or his
designee is hereby charged with the responsibility of insuring compliance with
all other applicable statutory purchasing requirements set forth in Title 31,
Chapter 7, Mississippi Code of 1972, as now or hereafter amended.
