Mont. Admin. r. 17.24.503 - SMALL DEPRESSIONS
(1) The requirement to
achieve approximate original contour does not prohibit construction of small
depressions if they are approved by the department to minimize erosion, conserve
soil moisture, or promote vegetation or wildlife use. These depressions must be
compatible with the approved postmining land use and may not restrict normal access
throughout the area or constitute a hazard. Large, permanent impoundments are
governed by ARM
17.24.504 and
17.24.642.
