Nev. Admin. Code § 439B.447 - Presentation of evidence at hearing
At a hearing held pursuant to NAC 439B.446:
1. Except as otherwise provided in subsection
3, the hospital and the county may present evidence in support of their
positions.
2. The director or his
designee may request any information or documentation that he deems necessary
to render a decision on the appeal.
3. Except as otherwise provided in subsection
2, the hospital shall not present evidence other than the information and
documentation specified in NAC
439B.443, unless it has shown to
the satisfaction of the director or his designee that the evidence is material
and there is good cause for its failure to present the evidence to the county.
The director or his designee may consider the additional evidence or may order
the hospital to submit the additional evidence to the county and remand the
application to the county.
