Nev. Admin. Code § 459.9988 - Corrective action concerning soil or groundwater; assessment of contaminated soil or water
1. An owner or
operator of a storage tank who submits a report pursuant to NAC 459.996 or a
notice pursuant to NAC 459.9972 shall comply with the provisions of NAC
445A.226 to 445A.22755, inclusive. The Division may allow the owner or operator
to use any alternative technology approved by the Division when taking any
corrective action concerning soil or groundwater pursuant to those
provisions.
2. If the report or
notice indicates that a regulated substance has been released, the Division may
require the owner or operator to assess any soil or water contaminated by the
release to determine whether the presence of any hazardous waste was created by
the release.
3. As used in this
section, "hazardous waste" has the meaning ascribed to it in NAC
445A.826.
