Nev. Admin. Code § 534.424 - Plugging of well: Responsibility for cost
1. If a well is
located on private land, the owner of the land at the time the well is plugged
is responsible for the cost of plugging the well.
2. Except as otherwise provided in subsection
3, if a well is located on public land, the person who last drilled or used the
well is responsible for the cost of plugging the well. If the person who last
drilled or used the well does not plug the well after receiving notice from the
Division by certified mail, return receipt requested, that the well must be
plugged, the Division shall notify the person who owns the land on which the
well is located that it is his or her responsibility to plug the
well.
3. If there is a notarized
affidavit on file with the Division acknowledging responsibility for plugging a
well that is located on public land, the person who acknowledged responsibility
for plugging the well in such affidavit is responsible for the cost of plugging
the well. If that person does not plug the well after receiving notice from the
Division by certified mail, return receipt requested, that the well must be
plugged, the Division shall notify the person who owns the land on which the
well is located that it is his or her responsibility to plug the
well.
