N.H. Admin. Code § Hum 209.02 - Investigation Summation Letter
(a) When the
investigator has completed the investigation, he or she shall send to the
parties an investigation summation letter containing the following information:
(1) The fact that the investigation has been
completed;
(2) A list of documents
reviewed in the course of the investigation;
(3) Identification of non-documentary
evidence, other than the statements of individuals, reviewed in the course of
the investigation; and
(4) A
statement of the deadline, set at least 2 weeks into the future, for a response
by the party receiving the letter.
(b) A party receiving an investigation
summation letter described in (a) above shall have the opportunity to respond
to it by:
(1) Submitting by the deadline
established in the letter a written response sent by United States mail,
facsimile or e-mail; and
(2)
Identifying in the written response one or both of the following:
a.Additional documents the party believes are
relevant to the matter under investigation; and
b.The names of additional individuals the
party believes to have information relevant to the matter under investigation,
together with:
1.Their residential addresses
and phone numbers; and
2.A brief
description of the information the party believes each named individual can
provide.
(c) Noncompliance with the deadline for
response set in the investigation summation letter, or the failure of a
response to comply with the requirements of (b)(2) above, shall result in
denial of that part of a motion for reconsideration of a determination of
probable cause which rests on the failure of the investigator to review the
additional documents identified in the response or the failure of the
investigator to interview the additional individuals named in the
response.
