N.H. Admin. Code § Rko 207.08 - Rejection of Appearances
The ombudsman shall reject an appearance if:
(a) The appearance does not contain the
information required by Rko 207.02;
(b) The appearance does not clearly and
accurately identify the person, organization, or other entity which the person
filing the appearance intends to represent; or
(c) The appearance is filed on behalf of
another person; and
(1) The person filing the
appearance has in the past been admonished for conduct occurring in another
proceeding before the office and:
a. Such
conduct was not rectified as of the conclusion of the proceeding in which the
person previously appeared; and
b.
The appearance filed in the subsequent case is not accompanied by a letter
addressed to the ombudsman and copied to all other persons whose appearances
are of record which explains what steps will be taken to avoid the situation
previously resulting in an admonition;
(2) The person filing the appearance has in
the past been subject to sanctions for conduct occurring in an official
proceeding before another agency or branch of government while that person was
serving as a representative; and
a. Such
sanctions have not been fulfilled; and
b. The appearance is not accompanied by a
letter addressed to the ombudsman and copied to all other persons whose
appearances are of record which explains what steps will be taken to avoid the
situation previously resulting in a sanction; or
(3) The person filing the appearance is an
attorney who is presently disbarred or suspended from practice in any
jurisdiction.
