N.H. Admin. Code § Rko 208.02 - Motions to Continue
(a) Any party or intervenor may make an oral
or written motion that a proceeding, other than a public comment hearing, be
delayed or continued to a later date or time.
(b) A motion for a delay or a continuance in
a hearing or conference, other than a public comment hearing, shall be granted
if the presiding officer determines that a delay or continuance would:
(1) Likely assist in resolving the case
fairly, such as by allowing for the presence of a necessary party or witness
who was unavoidably unavailable at the scheduled time; and
(2) Not be contrary to law.
(c) If the later date, time, and
place to which the hearing or conference under (b) above will be delayed or
continued are known at the time of ruling on a motion, that information shall
be stated on or in the record.
(d)
If the later date, time, and place to which the hearing or conference under (b)
above will be delayed or continued are not known at the time of a ruling on a
motion, the presiding officer shall, as soon as practicable thereafter, issue a
written scheduling order stating the date, time, and place of the delayed or
continued hearing or conference.
