N.H. Admin. Code § Rko 209.01 - Sufficiency of Complaints
(a) Pursuant to
RSA
91-A:7-b, I, a complaint
shall be deemed sufficient if, on its face, it states facts which, if true, and
if viewed in a light most favorable to the claimant, would constitute a
violation of RSA 91-A.
(b)
Complaints which do not, on their face, state facts which, if true, would
constitute a violation of RSA 91-A shall, upon motion, or sua sponte, be
dismissed.
(c) A complaint which
solely alleges a violation of Part 1, Article 8 of the New Hampshire
Constitution, or other law, and not a violation of RSA 91-A itself, shall be
subject to dismissal following the submission of a motion to dismiss, or sua
sponte pursuant to Rko 102.01(c).
