N.J. Admin. Code § 12:110-4.9 - Imminent danger
(a) As soon as a
Compliance Officer concludes, on the basis of an inspection, that conditions or
practices exist in any establishment or field site which could reasonably be
expected to cause death or serious physical harm immediately or before the
imminence of such danger can be eliminated through the enforcement procedures
otherwise provided by the Act, he or she shall inform the affected employees
and employers of the danger. The Compliance Officer shall also inform the
affected employees and employers that he or she is recommending a civil action
to abate such conditions or practices and for other appropriate relief in
accordance with the Act.
(b) Any
order issued with respect to an imminent danger may require such steps to be
taken as may be necessary to avoid, correct or remove such imminent danger and
prohibit the employment or presence of any individual in locations or under
conditions where such imminent danger exists.
