N.J. Admin. Code § 6A:33-5.1 - Presentation of countervailing evidence
(a) A Comprehensive or Targeted School and/or
its school district may dispute a Departmental finding or intervention made
pursuant to this chapter by initiating a contested case before the Commissioner
pursuant to N.J.A.C. 6A:3, Controversies and Disputes.
(b) The Department shall not be required to
suspend its activities, including the disputed intervention(s), while evidence
is being collected or presented by the school or school district, or while the
Department considers and responds to the evidence.
