CHAPTER HISTORICAL NOTE:
Chapter 100, State Health Plan, was adopted as R.1992 d.299, effective 7/20/1992. See: 24 New Jersey Register 1164(a), 24 New Jersey Register 2561(a). Attorney General Opinion 92-0094, issued July 15, 1992, advised that Assembly Bill 1144, enacted June 29, 1992 by the Legislature, prohibiting the promulgation of rules regarding the State Health Plan, violated constitutional principles of separation of powers and due process guarantees. See: 24 New Jersey Register 2702(a).
The validity of Chapter 100 was affected by an opinion filed by the New Jersey Superior Court, Appellate Division, on February 10, 1993. See: 25 New Jersey Register 3772(a). On February 28, 1994, the New Jersey Supreme Court affirmed the decision. In the Matter of the Adoption of Regulations Governing the State Health Plan, N.J.A.C. 8:100 et seq., 262 N.J. Super. 469 (App. Div.1993) aff'd 135 N.J. 24 (1994). See: 26 New Jersey Register 1828(b).
