N.M. Admin. Code § 1.12.4.13 - EXEMPTION
A. An agency may
request exemption from the requirement to participate in broadband circuit
aggregation efforts. Exemptions shall be granted only if aggregation would:
(1) result in a significant increase in
agency costs;
(2) decrease the
security of agency operations;
(3)
compromise essential service attributes critical to agency success;
or
(4) result in inadequate
resource levels.
B. An
agency shall file a written request for exemption with the CIO. The request
shall state the grounds on which the request is based and shall include any
information available to support the request. The CIO shall respond to the
request within thirty (30) days.
C.
Agencies may file a written request for review of an adverse CIO decision with
the commission. The commission shall review the CIO decision but shall only
consider information presented to the CIO, unless new information becomes
available that was not available at the time the agency submitted its request
for exemption to the CIO. The commission shall make a final decision at its
next regularly scheduled meeting.
