N.M. Admin. Code § 16.21.1.12 - TELEPHONIC ATTENDANCE BY BOARD MEMBERS
A. Pursuant to the provisions of the Open
Meetings Act, Subsection C of Section
10-15-1 NMSA 1978, board members
may participate in a board meeting by means of a conference telephone or
similar communications equipment, and participation by such means shall
constitute presence in person at the meeting. Such participation by telephone
may only occur when it is difficult or impossible for the member to attend in
person.
B. Each board member
participating by conference telephone must be identified when speaking and all
participants must be able to hear each other at the same time, and members of
the public attending the meeting must be able to hear any member of the public
or board members participating by phone.
