N.M. Admin. Code § 16.23.17.17 - FEDERAL FRAUD AND ABUSE DATA BANK
A. In accordance with federal requirements
imposed by the enactment of the Health Insurance Portability and Accountability
Act (HIPAA) of 1996, the department, in consultation with the board, shall
report any final adverse actions taken against a licensee or applicant, which
contain an admission or finding of guilt or liability, to the federal fraud and
abuse data bank established under HIPAA.
B. The department, in consultation with the
board, has the discretion not to report any final adverse action taken against
a licensee or applicant, which does not contain an admission or finding of
guilt or liability, to the federal fraud and abuse databank established under
HIPAA.
