N.M. Admin. Code § 17.7.3.16 - EXEMPTIONS
A. Motion for
exemption from rule: Upon motion by a utility and for good cause shown, the
commission may exempt public utilities with fewer than five thousand customers
and distribution-only public utilities from the requirements of this
rule.
B. Filing of a notice of
exemption from rule: Upon the filing of a notice of exemption in the utility's
most recent IRP docket, a utility shall be exempted from the requirements of
17.7.3.12 and
17.7.3.14 NMAC for the following
procurements:
(1) emergency procurements;
and
(2) capacity or energy from the
generation facilities of other utilities or from non-utility generators
pursuant to agreements for a two year term or less (including renewal terms) or
for 20 megawatts of capacity or less;
C. Multi-state resource planning: The
commission shall take into account a public utility's resource planning
requirements in other states and shall authorize utilities that operate in
multiple states to implement plans that coordinate the applicable state
resource planning requirements.
