N.M. Admin. Code § 19.10.14.1423 - SUBPOENAS
The Hearing Officer may issue subpoenas to compel attendance of witnesses and for the production of documents relevant to the Petition.
A. The Hearing Clerk shall,
upon request by any party and without the necessity for notice to other
parties, forward the proposed subpoena to the Hearing Officer for issuance. The
subpoena may be issued with the name and address of the witness blank, to be
completed by the requesting party.
B. A subpoena must be served on the person to
whom it is directed at least 7 days before the date set for the
hearing.
C. Any person to whom the
subpoena is directed may file a motion to modify the subpoena or quash the
subpoena (declare it void) within 5 days after service of the subpoena. Unless
the motion is granted in advance, the person to whom the subpoena is directed
is expected to be in attendance at the hearing.
