N.M. Admin. Code § 6.68.3.15 - APPEAL
A. A final decision
by the secretary after the hearing officer has made his or her recommendations
may be appealed to the district court by an applicant within thirty days of the
date of filing of the decision in accordance with Section
39-3-1.1, NMSA 1978. ("Appeal of
final decisions by agencies to district court--application--scope of
review--review of district court decisions")
B. The applicant may apply to the secretary
for a stay of his or her decision pending the outcome of the review of the
decision in district court.
