N.M. Admin. Code § 7.1.27.22 - PENALTIES FOR RULE VIOLATION
A.
Division sanctions: A requestor who violates the requirements of this rule may be subject to any or all of the following sanctions, as determined by the division.
(1) Temporary or permanent denial of access to HIS data or reports.
(2) Termination of current access.
(3) Mandated immediate return, without duplication, of HIS data or reports provided by the division.
B.
Other penalties: A requestor who violates the requirements of this rule or the HIS Act, may be subject to sanctions provided in applicable state, federal, or tribal laws or regulations, including but not limited to injunctive relief and civil penalties of up to $1,000 per violation.
