N.M. Admin. Code § 8.139.100.10 - PROGRAM OVERVIEW
A.
Establishment of the food stamp program: Sec. 4 (2013) (a) of the
act provides that subject to availability of funds appropriated under Section
18, the secretary is authorized to formulate and administer a food stamp
program under which eligible households within a state be provided an
opportunity to obtain a more nutritious diet through the issuance to the
household of an allotment.
B.
State participation: A state is prohibited from participating in
the food stamp program if it is determined that state or local sales taxes are
collected on purchases of food made with coupons issued under the
act.
C.
Retail stores:
Food stamp benefits used by households shall be used only to purchase food from
retail food stores which have been approved for participation in the food stamp
program. Benefits issued and used as provided in the act shall be redeemable at
face value by the secretary through the facilities of the treasury of the
United States.
