N.M. Admin. Code § 8.370.18.19 - CURRENTLY LICENSED FACILITIES
Any facility currently licensed on the date these regulations are promulgated and which provides the services prescribed under these regulations, but which fails to meet all building requirements, may continue to be licensed under the appropriate type of outpatient facility.
A. Variance may be granted for those building
requirements the facility cannot meet provided the variances granted will not
create a hazard to the health, safety and welfare of the patients and staff;
and
B. the building requirements
for which variances are granted cannot be corrected without an unreasonable
expense to the facility; and
C.
variances granted will be recorded and made a permanent part of the facility
file.
