N.M. Admin. Code § 8.371.2.75 - PHYSICAL RESTRAINT OF CLIENTS
Except as provided for behavior modification programs, the facility may allow the use of physical restraint on a client only if absolutely necessary to protect the client from injuring himself or others.
A. The facility may not use physical
restraint:
(1) as punishment;
(2) for the convenience of the
staff;
(3) as a substitute for
activities or treatment.
B. The facility must have written policies
that specify:
(1) how and when physical
restraints may be used;
(2) the
staff members who must authorize its use;
(3) the method for monitoring and controlling
its use.
C. An order for
physical restraint may not be in effect longer than 12 hours.
D. Appropriately trained staff must check a
client placed in a physical restraint at least every 30 minutes and keep a
record of these checks.
E. A client
who is in a physical restraint must be given an opportunity for motion and
exercise for a period of not less than 10 minutes during each two hours of
restraint.
