N.Y. Comp. Codes R. & Regs. Tit. 14 § 622.2 - Applicability

(a) Principles of compliance.

(1) The provisions of this Part shall apply and take effect as prescribed in article 8 of the Environmental Conservation Law.

(2) This Part applies to all actions undertaken by the OPWDD or which require approval by the OPWDD, including all actions on the grounds of facilities identified in Article 13.17 of the Mental Hygiene Law.

(3) This Part does not apply to actions by private persons where only ministerial action (see glossary) is involved. The lists of actions identified in section 622.4 are intended to cover only actions of the OPWDD or actions which must be approved, funded or otherwise acted upon by the OPWDD.

(4) This Part shall take effect on November 1, 1989.
