N.Y. Comp. Codes R. & Regs. Tit. 9 § 9610.5 - Responsibility for prompt determination of eligibility
(a) Upon receipt of an application for
coverage, the contractor shall conduct an appropriate review and verification
and secure, record and evaluate its findings in order to promptly determine
eligibility or ineligibility.
(b)
The decision to accept or deny the application shall be made as soon as the
facts to support it have been established, but not later than 30 days from the
date of application, except where the applicant requests additional time or
where difficulties in verification lead to unusual delay.
