Ohio Admin. Code 102-9-04 - Motions
(A) The commission
chairman, vice-chairman in the chairman's absence or
unavailability, or hearing officer if appointed by the commission, shall
will rule on all
motions, or may
designate the chair or another member of the commission to rule on
motions.
(B) All motions will
specifically state both the relief sought by the moving party and the basis for
granting such relief.
(C) All
motions shall be filed in writing and served at least
five business days prior to the hearing date.made prior to the hearing must be in writing. All motions
and supporting documentation must be served on the opposing party or
representative not less than five days prior to the hearing. The
commission may waive the five-day requirement for good cause shown.
Dispositive motions are not permitted to be filed under
this rule.
