Ohio Admin. Code 124-11-19 - Failure to appear
(A) If neither the appellant nor appellant's
authorized representative appears at a hearing, prehearing, or other scheduled matter, the board may
dismiss the appeal.
(B) If neither
the appellee nor appellee's authorized representative appears at a hearing,
prehearing, or other scheduled matter, the board
may grant appropriate relief, including disaffirmance of the order.
(C) If neither party appears at a hearing,
prehearing, or other scheduled matter, the board
may, based upon the information available to it, resolve the appeal in the
manner it deems appropriate.
