Ohio Admin. Code 3745-50-501 - Permitting program requirements - purpose and scope
Chapter 3745-50 of the Administrative Code:
(A)
Contains procedures for issuing, modifying, or revoking
all hazardous waste management permits. Hazardous waste permit by rule is not a
"permit" and is covered by specific provisions in Chapter 3745-50 of the
Administrative Code. The procedures of Chapter 3745-50 of the Administrative
Code also apply to denial of a permit for the active life of a hazardous waste
management facility or hazardous waste management unit under paragraph (D) of
rule 3745-50-44 of the Administrative
Code.
(B)
Covers several main subjects:
(1)
General
procedural requirements applicable to all permits;
(2)
Supplements to
the general provisions with requirements that apply to only certain types of
permits:
(a)
The
steps Ohio EPA will follow in receiving permit applications, preparing draft
permits, issuing permit-related public notices, and inviting public comment and
holding public hearings on draft permits. Chapter 3745-50 of the Administrative
Code also covers assembling an administrative record, responding to comments,
issuing a final permit decision, and allowing for administrative appeal of the
final permit decisions;
(b)
Public participation requirements applicable to all
hazardous waste management facilities;
(c)

(e)
Rules 3745-50-700
to 3745-50-711 of the Administrative Code contain specific procedural
requirements for hazardous waste standardized permits, which, in some
instances, change how other rules in Chapter 3745-50 of the Administrative Code
apply in the context of the standardized
permit.
(C)
Provides an
opportunity for public hearings regarding permits.
(D)
Is designed to
allow permits for a given facility under two or more types of hazardous
waste-related permits to be processed separately or together at the choice of
the director. This allows Ohio EPA to combine the processing of permits only
when appropriate. The director may consolidate permit processing when the
permit applications are submitted, when draft permits are prepared, or when
final permit decisions are issued. Chapter 3745-50 of the Administrative Code
also allows consolidated permits to be subject to a single public hearing.
Permit applicants may recommend whether or not their applications should be
consolidated in any given case.

Allows some types
of permit applications to be jointly processed, joint comment periods and
hearings to be held, and final permits to be issued separately or jointly when
different types of hazardous waste-related permits will be issued by Ohio
EPA.
