Respondents in any action brought to enforce the regulations adopted under Chapter 3734. of the Revised Code or RCRA subtitle C, upon a showing by the government that the respondent managed wastewater treatment sludges from the production of vinyl chloride monomer or ethylene dichloride, shall demonstrate that the respondents meet the terms of the exclusion provided in this description. In doing so, the respondents shall provide appropriate documentation (e.g., contracts between the generator and the landfill owner or operator, invoices documenting delivery of waste to landfill, etc.) that the terms of the exclusion were met. |
