Ohio Admin. Code 3745-599-360 - Renewal of an individual beneficial use permit
(A)
A permittee who
seeks to continue beneficial use or distribution of a beneficial use byproduct
after the expiration of an individual beneficial use permit may submit to the
director an application for renewal of the individual beneficial use permit not
later than one hundred eighty days prior to the individual beneficial use
permit's expiration date. An application for renewal shall include the items
and information specified in paragraphs (A) and (B) of rule
3745-599-310 of the
Administrative Code and shall be accompanied by a non-refundable application
fee of three hundred fifty dollars. In addition, the application shall include
a copy of the laboratory results for each compliance demonstration that has
occurred since the approval of the individual beneficial use permit the
permittee is seeking to renew.
(B)
If an applicant
submits a complete application for renewal of an individual beneficial use
permit not later than one hundred eighty days prior to the expiration date of
the existing individual beneficial use permit and Ohio EPA has neither approved
nor denied the application for renewal prior to the expiration of the existing
individual beneficial use permit, the existing individual beneficial use permit
shall be effective until the application for renewal is either approved or
denied by the director.
(C)
If an applicant submits an application for renewal not
later than one hundred eighty days prior to the expiration date of the existing
individual beneficial use permit and the application for renewal is denied by
the director, the existing individual beneficial use permit expires on the
effective date of the denial of the application for renewal or the expiration
date of the existing individual beneficial use permit, whichever is
later.
(D)
If an applicant fails to submit an application for
renewal not later than one hundred eighty days prior to the expiration date of
the existing individual beneficial use permit, the existing individual
beneficial use permit expires on the expiration date specified in the
individual beneficial use permit and the permittee shall not continue
beneficial use or distribution of the beneficial use byproduct until
authorization for the beneficial use or distribution under this chapter has
been obtained.
(E)
An applicant seeking renewal of an individual
beneficial use permit shall submit to Ohio EPA a revised renewal application
for an individual beneficial use permit not later than ninety days after the
date of written notification that the application is incomplete. The director
may deny an incomplete application or return the application to the
applicant.
(F)
If the director concludes that additional information
is necessary to determine whether an application for renewal satisfies this
chapter, upon written request the applicant shall supply such additional
information.
(G)
The renewal of an individual beneficial use permit is
subject to the same requirements as the issuance of a new individual beneficial
use permit pursuant to this chapter.
