Ohio Admin. Code 3746-5-21 - Stays
(A)
The filing of an appeal does not suspend or stay
execution of the action being appealed. Upon motion by appellant and for
compelling reasons justifying it, the commission may suspend or stay such
execution pending immediate determination of the appeal without interruption by
continuances, other than for unavoidable circumstances.
(B)
A motion for stay
may be filed with the commission at any time during the proceeding and shall
set forth the specific reasons for which it is being requested. In granting a
stay, the commission may impose such conditions as are warranted by the
circumstances including, where appropriate, the filing of a bond or other
security as provided for in rule
3746-5-23 of the
Administrative Code.
