Ohio Admin. Code 3746-5-30 - Dismissal of actions
(A)
An appellant may
dismiss an appeal by written motion to the commission at any stage of a
proceeding.
(B)
All rulings granting a motion to dismiss shall be with
prejudice to refiling and all rulings of the commission granting dismissal
shall be entered in the journal.
(C)
Where an
appellant fails to pursue an appeal or fails to comply with these rules or
orders of the commission, the commission, upon motion of appellee or upon its
own motion, may, after notice to the appellant, dismiss an appeal for want of
prosecution.
