Ohio Admin. Code 4301:1-1-37 - Chemical analysis requirements
(A) Except for those products registered
pursuant to division (A)(8)(B) of section
4301.10 of the Revised Code,
which are for sale in the state and are accompanied by a copy of the federal
label and product approval, every distiller, bottler, manufacturer or
compounder manufacturing prepared beer, wine, or mixed beverages, having an
alcoholic content of not less than one-half of one per cent by volume and not
more than twenty-one per cent by volume, and sold or distributed in the state
of Ohio is required on demand to submit to the division for chemical analysis
at least a twenty-five fluid ounce representative sample of each brand in the
original container, such samples to be furnished without expense to the
division. This rule shall also apply to holders of B-1, B-4 and B-5 permits who
sell or distribute in Ohio beer, wine, and mixed beverages having an alcoholic
content of not less than one-half of one per cent by volume and not more than
twenty-one per cent by volume.
(B)
All manufacturers and wholesale distributors of beer, wine and mixed beverages
shall upon demand of the commission or division furnish without cost to the
commission or division samples of any and all beer, wine and mixed beverages
manufactured or sold by them, for the purpose of examination and chemical
analysis.
