Ohio Admin. Code 4906-3-10 - Proof of publication
(A)
The applicant shall file a copy of the initial notice
with the board within fourteen days after the notice is sent.
(B)
The applicant
shall provide proof of the second public notice to the board at least three
days before the public hearing by filing a copy of the notice sent to persons
pursuant to rule
4906-3-09
of the Administrative Code and providing either a copy of the entire
date-marked newspaper page that contains the actual notice or copy of the proof
of publication from the newspaper(s) in which the notice was
published.
(C)
Inadvertent failure of service on, or notice to, any
of the persons entitled to receive service pursuant to the requirements for
this chapter, may be cured pursuant to orders of the board or the
administrative law judge, designed to afford such persons adequate notice to
enable their effective participation in the proceeding. In addition, the board
or the administrative law judge may, after filing, require the applicant to
serve notice of the accepted, complete application or copies thereof, or both,
upon such other persons, and file proof thereof, as the board or the
administrative law judge considers appropriate.
