Okla. Admin. Code § 377:10-15-3 - Testing of juveniles
(a) All
juveniles in the custody of the Office of Juvenile Affairs who have been
adjudicated delinquent or found to be a youthful offender may be subject to
drug testing for the purpose of prevention and intervention for substance
abuse.
(b) Juveniles who are not in
the custody of OJA may participate in drug testing only with written voluntary
consent of:
(1) the juvenile and legal
guardian; or
(2) upon court
order.
(c) The drug test
results shall not be used in any new juvenile or criminal charge.
(d) All drug test results of juveniles shall
be confidential and shall only be released by court order or in accordance with
state or federal statute. Any and all releases of test results shall be
documented in the juvenile's case file, including to whom and when the release
occurred.
