Or. Admin. Code § 255-032-0029 - Subpoenas for a Murder Review Hearing
(1) Inmates must make their own arrangements
for calling and presenting witnesses. However, upon the request of an inmate,
and upon a proper showing of general relevance and reasonable scope of the
evidence being sought, the Board may issue subpoenas on behalf of the
inmate.
(2) Witnesses are not
required to appear in person unless good cause can be shown why an in-person
appearance is necessary. Witnesses may participate via
teleconference.
(3) Witnesses
appearing pursuant to subpoena, other than inmates, state officers, or
employees of the Board, must receive fees and mileage payable by the Board as
prescribed by law for witnesses in ORS 44.415(2), provided the Board certifies
that the witness's testimony was relevant and material to the
hearing.
