Or. Admin. Code § 438-085-0810 - Failure to Appear
(1)
Except as provided in section (2) of this rule, failure of a party to appear at
the hearing shall be considered a default and a waiver of all rights except the
right to be served with a copy of the Administrative Law Judge's order and the
right to request judicial review in accordance with ORS
183.480 to
183.500. A default order may be
issued only upon a prima facie case made in the evidentiary
record.
(2) Upon a showing of good
cause, the Administrative Law Judge shall excuse a party's failure to appear
and reconvene the hearing.
