Or. Admin. Code § 461-196-0160 - Overpayments; SEBT
(1) The
Department (see OAR
461-196-0020) will pursue an
overpayment claim when:
(a) The overpayment
amount is $200 or more;
(b) The
filing group (see OAR
461-196-0020) was found eligible
through a Summer EBT (SEBT ) application; and
(c) An individual in the
filing
group knowingly obtained SEBT benefits through fraudulent activity and
there is an established intentional program violation (IPV) in accordance with
OAR 461-195-0611.
(2) The
Department will not recover an SEBT overpayment claim through
the reduction of the
filing group 's Supplemental Nutrition
Assistance Program (SNAP ) or any other public assistance benefits.
(3) Overpayments are calculated in accordance
with OAR 461-195-0521 and liability for
repayment of overpayments is addressed in OAR
461-195-0541.
