Or. Admin. Code § 471-030-0082 - Charge Relief for Part-Time Work
(1) For purposes of ORS
657.471(9)(a) and
(c):
(a)
"Part-time work" means hours of work which are less than full-time as defined
in OAR 471-030-0022;
(b) "Substantially the same amount" means
wages have been earned by the part-time employee, with respect to a week in the
benefit year, in an amount equal to 90 percent or more of the claimant's
average part-time weekly base year wage as determined in accordance with
section (2) of this rule.
(2) A claimant's average part-time weekly
base year wage shall be calculated by dividing the claimant's total base year
part-time wages paid by the employer requesting relief of charges, by the total
weeks of part-time work associated with such wages.
(3) The effective date for implementing this
rule shall apply retroactively, beginning October 7, 2013.
