Or. Admin. Code § 586-030-0085 - Board Members, Representatives or Legal Counsel as Witnesses
(1) No Board
Member, representative of the Board or legal counsel to the Board shall be
called or appear as a witness at a hearing on behalf of any party without the
prior consent of the panel.
(2) A
request for such testimony shall be in writing and filed with the Executive
Secretary to the Board at least ten (10) days before the scheduled commencement
of the hearing. It shall state the:
(a) Name
and capacity with the board of the witness whose testimony is sought;
(b) The specific area of testimony expected
from the witness; and
(c) An
explanation of why the testimony is necessary for the party's
presentation.
(3) The
panel's ruling on the request may be given orally or in writing and shall be
communicated to the parties in the most expeditious manner possible. The ruling
shall be set forth in the final order in the case.
