Or. Admin. Code § 603-073-0003 - Prohibitions
(1) Willful or
negligent cutting, digging, trimming, picking, removing, mutilating, or in any
manner injuring, or subsequently selling, transporting, or offering for sale
any plant, flower, shrub, bush, fruit, or other vegetation growing on the right
of way of any public highway within this state, within 500 feet of the center
of any public highway, upon any public lands, or upon any privately owned lands
is prohibited without the written permission of the owner or authorized agent
of the owner.
(2) The provisions of
section (1) of this rule do not apply to any federal or state government
employee or contractor in Oregon engaged in work upon any public road or
highway while performing such work under the supervision of any federal agency,
or any agency that represents a political subdivision of the State of Oregon.
This section likewise does not apply to private landowners while working on
their own property.
(3) This rule
does not apply to any person affecting a plant species which is declared by law
to be a noxious weed.
