Or. Admin. Code § 629-625-0650 - Vacating Forest Roads
(1) The purpose
of this rule is to ensure that when landowners choose to vacate roads under
their control, the roads are left in a condition where road related damage to
waters of the state is unlikely.
(2) To vacate a forest road, landowners shall
effectively block the road to prevent continued use by vehicular traffic, and
shall take all reasonable actions to leave the road in a condition where
road-related damage to waters of the state is unlikely.
(3) Reasonable actions to vacate a forest
road may include removal of stream crossing fills, pullback of fills on steep
slopes, frequent cross ditching, and/or vegetative stabilization.
(4) Damage which may occur from a vacated
road, consistent with Sections (2) and (3) of the rule, will not be subject to
remedy under the provisions of the Oregon Forest Practices Act.
