(1) Salmon (except
Chum) may be taken with gillnets for commercial purposes during open fishing
periods in Deep River as described below:
(a)
During the winter, spring, and summer seasons, the Deep River Select Area is
defined as waters bounded by a line at the mouth of Deep River from USCG marker
"16" southwest to a marker on the Washington shore, upstream to the Highway 4
Bridge.
(b) During the fall season,
the Deep River Select Area is defined as waters bounded by a line at the mouth
of Deep River from USCG marker "16" southwest to a marker on the Washington
shore, upstream to the West Deep River Road Bridge at the town of Deep
River.
(2) Open fishing
periods are established in four segments categorized as the winter season in
subsection (2)(a); the spring season in subsection (2)(b); the summer season in
subsection (2)(c); and the fall season in subsection (2)(d).
(a) Winter Season
(A) Open area includes the Deep River Select
Area defined in sub-section (1)(a) above.
(B) The minimum mesh size is
7-inches.
(C) Open fishing periods
are as follows:
(i) February 13 through March
21, each Sunday, Tuesday, and Thursday from 7:00 p.m. to 9:00 a.m. the
following day; and
(ii) March 24
through April 15, each Monday and Thursday from 7:00 p.m. to 9:00 a.m. the
following day.
(b) Spring Season
(A) Open area includes the Deep River Select
Area defined in sub-section (1)(a) above.
(B) The maximum mesh size is
9.75-inches.
(C) Open fishing
periods are as follows:
(i) April 17 through
April 25, each Monday and Thursday from 7:00 p.m. to 9:00 a.m. the following
day;
(ii) April 28 through May 2,
each Monday, Wednesday, and Thursday from 7:00 p.m. to 9:00 a.m. the following
day; and
(iii) May 5 through June
13, each Monday, Tuesday, Wednesday, and Thursday from 7:00 p.m. to 9:00 a.m.
the following day.
(c) Summer Season
(A) Open area includes the Deep River Select
Area defined in sub-section (1)(a) above.
(B) The maximum mesh size is
9.75-inches.
(d) Fall
Season
(A) Open area includes the Deep River
Select Area defined in sub-section (1)(b) above.
(B) The maximum mesh size is 9.75-inches
prior to the second Sunday in September, and 6-inches thereafter.
(3) Additional gear
restrictions include:
(a) The maximum net
length is 600 feet (100 fathoms).
(b) There is no lead line weight limit and
attachment of additional weight or anchors directly to the lead line is
permitted.
(c) Nets may not be tied
off to stationary structures.
(d)
Nets may not fully cross the navigation channel.
(e) It is unlawful to operate any gillnet
gear longer than three-fourths the width of the river which is defined as
bank-to-bank, where the water meets the banks, regardless of the time of tide
or the water level.
(f) Nets not
specifically authorized for use may be onboard a vessel if properly stored. A
properly stored net is defined as a net on a drum that is fully covered by a
tarp (canvas or plastic) and bound with a minimum of ten revolutions of rope
with a diameter of 3/8 (0.375) inches or
greater.
