Or. Admin. Code § 738-070-0090 - Acknowledgment of Notice
(1) Within
20 working days, the Department will acknowledge receipt in writing of each
notice submitted under OAR
738-070-0070.
(2) If the construction or alteration
proposed in a notice is one for which lighting or marking standards are
prescribed in the FAA Advisory Circular AC 70/7460-1F entitled
Obstruction Marking and Lighting, dated September 27, 1978, the
acknowledgment will contain a statement to that effect and information on how
the structure should be marked and lighted in accordance with the Advisory
Circular.
(3) The acknowledgment
will state that an initial or preliminary aeronautical study of the proposed
construction or alteration has resulted in a determination that the
construction or alteration:
(a) Would not
exceed any standard of OAR
738-070-0100 and would not be a
hazard to air navigation;
(b) Would
exceed a standard of OAR 738-70-100 but would not be a hazard to air
navigation; or
(c) Would exceed a
standard of OAR 738-070-0100 and further
aeronautical study is necessary to determine whether it would be a hazard to
air navigation, that the sponsor may request in writing within 30 days such
further study, and that, pending completion of any further study, it is
presumed the construction or alteration would be a hazard to air
navigation.
