Or. Admin. Code § 808-004-0510 - Court Judgments and Other Authorized Entity Determinations
(1) As used in this
rule a "court judgment, arbitration award or other entity determination" means
a judgment, award or determination by a court, arbitrator or other entity, as
that phrase is defined in Division 2 of this chapter.
(2) The agency may not issue an order for the
payment of a court judgment, arbitration award or final order from a bond or
letter of credit or deposit unless the claim was
(a) timely filed with the agency,
(b) that claim is regarding the same matter
that resulted in the judgment, final order or award; and
(c) the board is able to determine from
review of the pleadings and ultimate form of judgment, final order or award the
individual amounts, or sum total amount, awarded for an item or collection of
items, set forth in the claim filed with the Board that are within the Board's
jurisdiction.
(3) Upon
the effective date of the 2023 rule amendments, the provisions of this rule
will apply to:
(a) all claims that remain open
at the Board, and
(b) all claims
received after the effective date of the 2023 rule amendments.
(4) The 2023 amendments to this
rule will not be applied to claim cases closed prior to the effective date of
this rule.
