Or. Admin. Code § 837-085-0160 - Trade Secrets - Determinations and Response
The State Fire Marshal shall respond in writing to the requesting employer, owner or operator for trade secret protection within 60 days after the request has been received:
(1) The response shall advise the requesting
employer, owner or operator as to whether or not trade secret protection is
granted.
(2) The employer, owner or
operator will be advised of disclosure requirements if trade secret protection
is granted.
(3) If trade secret
protection is denied, the State Fire Marshal shall provide the employer, owner
or operator with the criteria used to make the determination.
(4) If trade secret protection is denied, the
State Fire Marshal shall state the reasons why.
(5) The employer, owner or operator will be
advised of the appeal rights.
