Or. Admin. Code § 859-300-0090 - Principal Issue Before The Panel/Challenges to the Firearm Disqualification
(1)
The sole issue at any Gun Relief hearing shall be whether the petitioner has
demonstrated that he or she will not be likely to act in a manner that is
dangerous to public safety and that granting the relief would not be contrary
to the public interest.
(2)
Petitions asserting other grounds for relief, including, but not limited to,
erroneously entered mental health determination disqualifications into the NICS
database, shall not be heard by the PSRB. Record correction challenges should
be directed to the agency that submitted petitioner's name to the Oregon State
Police for entry into the firearm disqualification databases or the Oregon
State Police Records Unit or the Federal Bureau of Investigation, Criminal
Justice Information Services Division NICS Section.
